Can a married Florida schoolteacher be fired for having an affair with another married person?

Jeff R asked:

They are both married, but cheating on their spouses. There is 100% proof. Is there an ethics clause or anything in the state of Florida for teachers?

Most states have moral clauses in their teacher’s contracts. It could be cause for dismissal ~

Yes, they can. Florida’s teacher contract has a clause about ethical personal behavior and one about public image, both of which are violated by extra-marital affairs.

You would be surprised what has been considered unethical behavior, and grounds for dismissal, on teacher contracts. For example, co-habitation with a member of the opposite sex, and drinking alcohol in public, have both been found to be violations of Florida’s ethical behavior policy in the past. Although these particular examples have since been changed in Florida, they are still listed on teacher contracts in several other southern states.

So, yes, you can be fired for having an affair. However, it is rare that teachers are fired in Florida for extra-marital affairs. Generally the reason the teacher gets fired is because they lied to county officials after the affair was discovered. So, be honest and up-front with the district if they investigate and usually it will end with a reprimand.

One note of solice though. Most extra-marital affairs by teachers go completely ignored by the school district. Unless there is some reason to investigate because they think the school, or children, or district has been harmed by it, the administrators will generally just turn a blind eye. It is only very rarely that they do anything at all.
